1. Scope

The following General Terms and Conditions (GTC) apply to all contracts, deliveries and other services to consumers.

A consumer is any natural person who concludes a legal transaction for a purpose that cannot be predominantly attributed to either his or her commercial or independent professional activity.

2. Offer

Our offers are non-binding. The presentation of the products in our online shop does not constitute a legally binding offer but an invitation to order. Small deviations and technical changes compared to our illustrations or descriptions are possible.

3. Prices, delivery and shipping costs

The delivery conditions of AMS are detailed in the order form. There is no minimum order quantity. All our prices include the statutory VAT currently amounting to 19% or 7% (books). Book shipments, the "Glucosamine Gold Gel" (order no. 650), and the CD-ROM BIOINFORMATIVE MEDICINE (order no. 406) are shipped free of charge in Germany. For all other products, we charge a flat shipping fee of 7 euros or 15 euros within Germany, depending on the product. Sample vials, the attachment tip for the CEPES laser and the ampoule holder are shipped within Germany with a shipping fee of 4 euros. The applicable shipping costs are clearly communicated to you in the shopping cart system or on the order page. For deliveries to other EU countries or to all other countries, other flat shipping fees apply, which are also displayed on the order page.

4. Delivery times

Ordered goods will be dispatched within a maximum of 3 working days. Any different delivery times will be indicated on the respective product page.

5. Cancellation policy

If you are an entrepreneur within the meaning of Section 14 of the German Civil Code (BGB) and are acting in the exercise of your commercial or independent activity when concluding the contract, the right of withdrawal does not apply.

Right of withdrawal

You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the last goods.

To exercise your right of withdrawal, you must contact us (AMS GmbH, Hauptstraße 26, 97990 Weikersheim, Telephone 07934/993489-0, Fax 07934/993489-44, E-Mail ) by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract. You can use the following sample withdrawal form for this purpose, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation

You must return or hand over the goods to us promptly and in any event no later than fourteen days from the date on which you notify us that you have cancelled this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period. You will bear the direct cost of returning the goods.

You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.

OUR VOLUNTARY RETURN GUARANTEE for article/order numbers 100-107 (MEDISEND, MEDISEND protect, MEDICUR pro, METRONOM solar, METRONOM C, MEDICUR color and CEPES-Laser):
Without prejudice to your statutory rights, AMS offers you the following voluntary return guarantee:
You can return all small appliances mentioned above (item/order no. 100-107) to AMS within 90 days of receipt of the goods.

If you return goods in accordance with this voluntary return guarantee, we will refund the purchase price you have already paid, but not the shipping costs of your original purchase. The condition is that the goods are in perfect condition. However, the intended use of the goods is permitted. It is not necessary to replace used batteries with new ones. The transport risk and the return costs are at your expense.
This extended return guarantee does not limit your statutory rights and therefore does not limit your right of withdrawal as described above.

This voluntary return guarantee is not valid for reduced-price goods or special sales promotions.

6. Consumer Dispute Settlement Act

The Consumer Dispute Settlement Act (VSBG) does not apply to the AMS due to the number of employees. The AMS does not participate in dispute settlement proceedings before a consumer arbitration board.

7. Payment methods

Payment can be made either in advance (you will receive an invoice PDF with the necessary details of our bank account with the order confirmation and we will deliver the goods to you after receipt of payment), cash on delivery (only possible in Germany and only possible if shipping is carried out or selected by GLS), direct debit / bank debit (possible throughout Europe), credit card (Master and Visa; your credit card will be charged when your order is completed), PayPal (you must be registered with PayPal or register first, authenticate yourself with your access data and confirm the payment instruction to us) and by invoice (only possible for existing customers).

8. Disclaimer

The use of the products offered is at your own risk. The products are in no way a substitute for examination and treatment by a doctor or alternative practitioner. None of the products, with the exception of the MEDICUR pro product, is a medical device within the meaning of the MPG (Medical Devices Act).

9. Retention of title

The goods remain the property of AMS until full payment has been made.

10. Data storage

In accordance with Section 28 of the Federal Data Protection Act (BDSG), we would like to point out that the data required for business transactions are processed and stored using an IT system in accordance with Section 33 (BDSG). Personal data will of course be treated confidentially and will not be passed on to third parties.
